Draft for legal review
This Acceptable Use Policy (AUP) applies to use of Lambda Twelve hosting, network, compute, storage and related services. It forms part of the Terms of Service.
The objective is straightforward: customers may use the services for any lawful purpose that does not materially harm Lambda Twelve, other customers, third parties or the operation of the service.
1. Customer responsibility
Customers are responsible for content they upload, store, transmit or make available and for activity carried out through their accounts and systems, except to the extent caused by Lambda Twelve.
Customers must obtain all rights, permissions and licences required for their content and activities.
Lambda Twelve does not impose a general obligation to monitor customer content.
2. Illegal content and activity
You must not use the services to store, publish, transmit, facilitate or materially support content or activity that is illegal under applicable law.
This includes use that infringes intellectual-property rights, facilitates fraud, distributes unlawful material, unlawfully processes personal data, or otherwise violates binding legal requirements applicable to the customer or service.
3. Security abuse
You must not use the services to:
- deploy or distribute malware, ransomware, credential-stealing software or malicious code;
- conduct phishing, credential harvesting or impersonation for fraudulent purposes;
- gain or attempt to gain unauthorised access to systems, accounts, networks or data;
- conduct denial-of-service attacks or knowingly participate in attack infrastructure;
- scan, probe or test third-party systems without authorisation where such activity is unlawful or abusive;
- operate command-and-control infrastructure for malicious activity; or
- conceal or facilitate security abuse in a manner intended to evade legitimate response.
Legitimate security research, authorised penetration testing and defensive scanning are permitted where the customer has the necessary authority and the activity does not materially disrupt Lambda Twelve infrastructure or third parties.
4. Messaging and network abuse
You must not use the services for unsolicited bulk messaging, spam, mail-bombing, abusive automated communications or deliberate circumvention of reasonable anti-abuse controls.
Customers operating mail services are responsible for appropriate configuration and reputation management. Lambda Twelve may apply proportionate network controls where necessary to protect address reputation or infrastructure.
5. Resource abuse
Services may be subject to technical limits stated in the Order or product description. You must not deliberately evade such limits or use a shared service in a way that materially and persistently degrades service for other customers.
Where unusually high legitimate usage is creating a problem, Lambda Twelve will normally seek a technical or commercial solution rather than treating the usage as misconduct.
6. Intellectual property complaints
Notices alleging infringement should be sent to abuse@lambda-twelve.com and should identify the protected work/right, the allegedly infringing material and its exact location, the basis of the complainant's claim, and reliable contact information.
Lambda Twelve may request further information before acting where necessary to assess the notice.
7. Illegal-content and abuse notices
Any person or entity may notify Lambda Twelve of allegedly illegal content hosted through our services at abuse@lambda-twelve.com.
A notice should contain enough information to permit a meaningful assessment, including:
- a substantiated explanation of why the material is alleged to be illegal;
- the exact URL(s) or other precise electronic location of the material and any additional information needed to identify it;
- the notifier's name and email address, except where applicable law permits or requires otherwise; and
- a good-faith statement that the information supplied is accurate to the notifier's knowledge.
We may acknowledge receipt, request additional information and communicate a decision where required or appropriate. Submission of a notice does not guarantee removal; notices are assessed on their facts and applicable law.
8. Our response to abuse
Depending on seriousness, urgency, evidence and legal obligations, Lambda Twelve may:
- contact the customer and request remediation;
- restrict particular traffic, ports, services or content;
- temporarily isolate or suspend an affected system;
- remove or disable access to specific information where permitted or required;
- preserve relevant records where lawfully required;
- terminate service for serious or repeated violations; or
- comply with valid orders or requests from competent authorities.
Where circumstances permit, we favour targeted and proportionate action and will provide notice and an opportunity to remedy. Immediate action may be necessary for active attacks, compromise, serious illegal activity, imminent harm or binding legal requirements.
9. False or abusive reports
Do not knowingly submit false, misleading or abusive notices. Lambda Twelve may disregard notices that are manifestly unfounded, cannot identify the material concerned, or are submitted for harassment or disruption, subject to applicable law.
10. Law-enforcement and authority requests
Requests from public authorities should be sent to legal@lambda-twelve.com unless an emergency or legally prescribed channel applies. Lambda Twelve may verify the authority, scope and legal basis of a request before responding and will disclose only what it is legally required or permitted to disclose.
11. Changes
We may update this AUP to address changes in law, abuse patterns, security risks or service operation. Material changes affecting existing customers will be communicated where required by law or contract.
